Chapter One: Introduction
1.1 Background of the Study
The protection of children’s rights has been a critical issue worldwide, with international conventions and national constitutions providing frameworks for ensuring the welfare of children. The Nigerian Constitution, through Section 34, guarantees the right to life, liberty, and dignity of the human person, which includes the rights of children (Ogunyemi & Abubakar, 2024). In Damaturu LGA, Yobe State, however, there are concerns regarding the enforcement of these constitutional protections, as children often face neglect, child labor, early marriage, and other forms of abuse (Usman & Saidu, 2023). This study aims to examine the effect of constitutional law on the protection of child rights in Damaturu, assessing the roles of government agencies, legal systems, and local communities in safeguarding children’s rights.
1.2 Statement of the Problem
Despite the constitutional guarantee for the protection of children’s rights, violations remain prevalent in Damaturu LGA. This study will investigate the implementation of constitutional provisions for child protection, highlighting the challenges in enforcing these rights and identifying strategies to enhance their protection at the local level.
1.3 Objectives of the Study
To assess the effectiveness of constitutional law in protecting child rights in Damaturu LGA.
To investigate the prevalence of child rights violations in Damaturu LGA.
To propose measures for improving the enforcement of constitutional child rights protections in Damaturu LGA.
1.4 Research Questions
How effective is constitutional law in protecting child rights in Damaturu LGA?
What are the main forms of child rights violations in Damaturu LGA?
What strategies can be implemented to enhance the protection of children’s rights in Damaturu LGA?
1.5 Research Hypothesis
H₁: Constitutional law has not been effectively enforced in protecting child rights in Damaturu LGA.
H₂: Child labor, early marriage, and neglect are common violations of child rights in Damaturu LGA.
H₃: Strengthening child protection laws and community awareness will reduce child rights violations in Damaturu LGA.
1.6 Significance of the Study
This study will contribute to understanding the gaps in the protection of child rights in Damaturu LGA and provide recommendations for improving legal and institutional mechanisms. It will be valuable for child protection agencies, local governments, and non-governmental organizations working to safeguard children’s rights in the region.
1.7 Scope and Limitations of the Study
The study will focus on the protection of child rights within Damaturu LGA, Yobe State. Limitations may include access to sensitive data, especially regarding violations of child rights, and possible challenges in engaging local authorities or communities.
1.8 Operational Definition of Terms
Child Rights: Rights afforded to children, including the right to education, protection from abuse, and the right to live free from exploitation.
Constitutional Law: The body of law derived from the Nigerian Constitution that guarantees fundamental human rights, including child rights.
Child Labor: The exploitation of children through work that deprives them of their childhood, education, and well-being.
